Tips from a Trooper

This week we have two questions that are answered by Lt. Steven Kirk #154



Question:  “Is it legal to pass a funeral procession on the highway?”

First one must ascertain if the funeral procession is being escorted by law enforcement.  If the funeral procession is not escorted, it is lawful as long as it is done safely, but very disrespectful.  At this time there are no laws in effect that govern non-escorted funeral processions. There should not be a need for a law,  it's a respect issue.   A person has to put himself in the other's shoes.  Ask yourself, “How would I like it if someone passed my mother's funeral procession?”  Then I think you would have your answer.

Escorted funeral processions are different.  A driver must yield to emergency vehicles that are properly displaying an audible signal or red flashing lights, as outlined in Oklahoma State Statute 47:11-405A.  It is also unlawful for a driver to follow an emergency vehicle or interfere with the movement of such emergency vehicles as outlined in Oklahoma State Statute 47:11-405B.



Question:  “Is it legal to pass a military convoy?”

Military Convoys are exempt from municipal traffic regulations, except for speed limits, and have the right of way except for emergency vehicles, and carriers of the U.S. Mail, as outlined in Oklahoma State Statute 47:11-107.  So it is not lawful.
